Terms & Conditions

Welcome to FoodVans.com.au. These Terms & Conditions (“Terms”) govern your use of our website and the supply of goods and services by FoodVans Pty Ltd ACN XXXXXX (“FoodVans”, “we”, “us” or “our”). By placing an order or using our site, you agree to be bound by these Terms.

1. Definitions

  • “Customer” means the individual or entity placing an order with FoodVans or otherwise using our services.

  • “Goods” means all food trailers, trucks, vans, parts and accessories supplied by FoodVans.

  • “Services” means design, manufacture, customisation, delivery, maintenance or any other service provided by FoodVans.

  • “Price” means the total cost for Goods and/or Services, including GST and any additional fees.

2. Acceptance & Variation

  1. Placing an order or accepting delivery constitutes acceptance of these Terms.

  2. No amendment to these Terms is effective unless agreed in writing by both parties.

  3. FoodVans may vary prices or specifications if you request changes, or if there are increases in materials, labour or regulatory costs. We will notify you in writing of any variation and may require your written approval.

3. Quotations & Orders

  1. Quotes remain valid for 21 days unless otherwise stated.

  2. A deposit may be required; the amount will be specified in your order confirmation.

  3. All orders are subject to availability and FoodVans’ written acceptance.

4. Price & Payment

  1. Prices are as quoted or on our current price list at delivery.

  2. Payment terms:

    • Balance due on delivery or as specified on the invoice.

    • Unless otherwise agreed, payment is due within 7 days of invoice date.

  3. Accepted methods: EFT, credit card (surcharge may apply), or other methods agreed in writing.

  4. Late payment incurs interest at 2.5% per month, compounded monthly, plus recovery costs.

5. Delivery & Storage

  1. Delivery occurs when Goods are:

    • Collected from our premises by you or your carrier; or

    • Delivered to your nominated address.

  2. Delivery times are estimates only. We are not liable for delays.

  3. Uncollected Goods may incur storage fees after 30 days’ notice.

6. Risk & Title

  1. Risk passes to you on delivery.

  2. Title remains with FoodVans until full payment is received.

  3. Until title passes, you hold Goods as bailee and must insure them.

7. Customisation & Specifications

  1. You must supply accurate drawings and specifications. We are not liable for errors arising from incorrect data.

  2. All custom designs remain FoodVans’ intellectual property unless otherwise agreed.

8. Warranties & Liability

  1. We warrant Goods will be free from defects in materials and workmanship for 12 months from delivery.

  2. Exclusions:

    • Normal wear and tear

    • Damage from misuse, accidents, or improper maintenance

  3. Statutory rights under the Australian Consumer Law are not excluded.

  4. Our liability is limited to repair, replacement or refund of the defective Goods, at our option.

9. Returns & Cancellations

  1. Inspect Goods on delivery and notify us of any evident defects within 14 days.

  2. Returns accepted only with prior written approval and in original condition.

  3. Cancellation of custom orders is not permitted once manufacture has commenced. Deposits are non-refundable.

10. Privacy & Credit Reporting

  1. We collect and use personal information in accordance with our Privacy Policy.

  2. We may obtain and exchange credit reports with credit reporting bodies to assess creditworthiness or recover debts.

11. Default & Remedies

  1. Overdue payments may result in suspension of services or cancellation of orders.

  2. We may repossess unpaid Goods and recover associated costs.

  3. You indemnify us against all costs incurred in enforcing these Terms.

12. Force Majeure

Neither party is liable for delays or failures caused by events beyond reasonable control (e.g., natural disasters, strikes, government actions).

13. Governing Law

These Terms are governed by the laws of Victoria, Australia. Any disputes will be subject to the exclusive jurisdiction of Victorian courts.
